Just moments before the trial was ready to get underway, the defendants settled, but with it came a public apology from the defendants in open court to the 28 families there, as well. They assured everyone in the courtroom that as much as possible had been done to correct the problems that they believed caused the crash. In an unusual ruling, the court also allowed prominent aviation attorney Robert Clifford to make a short opening statement so that the families of the victims of Flight 4184 would be heard.

A number of families have contacted Clifford Law Offices to represent them in the loss of their loved ones in the Feb. 12, 2009 crash of Continental Connection Flight 3407 in Clarence Center near Buffalo, New York. All 49 people aboard and one person on the ground were killed. The National Transportation Safety Board (NTSB) held three days of hearings in May, 2009, calling 20 witnesses who tried to find out the reason for the crash.
