Clifford Law Offices Files Lawsuit on Behalf of Ohio Family who Lost Son in Plane Crash; Bob Clifford Writes NTSB and FAA for Answers

Press Release, 05/07/2009

Letter to NTSB

Letter to FAA

Clifford Law Offices, on Thursday, May 7, 2009, filed a lawsuit on behalf of the family of Johnathan Perry, a 27-year-old director at a major New York investment management firm who was killed in the crash of Continental Connection Flight 3407.

The lawsuit, the ninth filed on behalf of family members who lost loved ones in the Feb. 12 crash in Clarence Center near Buffalo, New York, was filed in federal court in the Western District of New York.  The complaint alleges numerous counts of negligence on the part of the airlines, the aircraft manufacturer and other corporate entities.

Robert Clifford, senior partner at Clifford Law Offices, wrote letters today on behalf of Robert and Denise Perry of Loveland, Ohio, Johnathan’s parents, to the National Transportation Safety Board (NTSB) and the Federal Aviation Administration (FAA) asking these governmental agencies, not only to find the cause of the crash, but to continue pushing for requirements that planes like the Bombardier Dash 8-Q400 to be required to have low airspeed alerter systems to give the pilots more warning time before the plane goes into a stall, which some experts have said may have occurred in the Feb. 12 crash.  Clifford is asking that NTSB officials discuss its recommendations at the May 12-14 public hearings scheduled next week on the crash.

“We want the mistakes, oversights, and airplane system deficiencies that caused or contributed to this accident to be uncovered and corrected to ensure that no other family ever endure such a preventable loss,” wrote Clifford to officials at the NTSB and FAA.  “This is a very painful process, but these families feel they must go through it so that the flying public is assured that all necessary steps are taken to prevent a similar tragedy.”

Johnathan Perry was traveling with his girlfriend to Buffalo to visit her parents for dinner.  He also left a brother and two sisters.

Robert Clifford is available to speak (312-899-9090) about the filing of the lawsuit and the letters he sent today to government aviation officials.  A copy of those letters are available for viewing at the law firm’s aviation website, www.CliffordAviation.com.

Also available to speak to the press are local counsel in Buffalo, Charles Desmond of Gibson, McAskill & Crosby, 69 Delaware Av., at 716-856-4200.
